You must be at least 18 years old to purchase our services or subscriptions.
3. Our services
We provide digital services including, for example: website development, ecommerce/technical services, SEO, automations, maintenance, and related professional services (the “Services”). Specific scope, deliverables, timelines, and pricing may be described on the Site, in a checkout page, in a proposal, or in written communications.
No digital delivery: Our Services are performed by us; they are not “digital downloads.”
4. Orders, project scope, and client responsibilities
- Scope: Only items explicitly included in the agreed scope are covered. Any additional work is a “scope change” and may require additional fees and timeline adjustments.
- Client inputs: You agree to provide timely access, content, credentials, approvals, and feedback needed to perform the Services. Delays in providing inputs may delay delivery deadlines.
- Third-party services: If your project requires hosting, domains, plugins, themes, APIs, ad accounts, email services, or other third-party tools, you are responsible for maintaining those accounts and paying their fees unless we explicitly agree otherwise in writing.
5. Subscriptions, auto-renewal, and cancellation
If you purchase a subscription (e.g., maintenance or ongoing services), it will auto-renew monthly unless you cancel.
- Billing cycle: monthly, charged in advance unless stated otherwise.
- How to cancel: You may cancel by following the cancellation instructions shown in your account/checkout system (if available) or by emailing admin@kmzhero.com.
- Effect of cancellation: Cancellation stops future renewals. You will generally retain service access through the end of the current paid billing period unless otherwise stated in writing.
We may suspend or terminate subscription services for non-payment or misuse.
6. Fees, payments, and taxes
- Prices are shown at checkout or in a written quote/proposal.
- You authorize us (and our payment processors) to charge your selected payment method for one-time purchases and recurring subscription charges.
- You are responsible for any applicable taxes, duties, or government charges unless we state otherwise.
7. No refunds (except if we cannot provide the service)
All sales are final and non-refundable, except when we are unable to provide the service as agreed. In that case, we may issue a refund at our discretion for the affected, unused portion of the service or the amount paid for the undelivered service.

8. Intellectual property
- The Site and our branding, templates, processes, and know-how are owned by KMZHERO or its licensors.
- For custom work, ownership/licensing of deliverables will be as specified in the written scope/proposal. If not specified, you receive a license to use the deliverables for your business purposes once full payment is received, excluding third-party components (themes, plugins, fonts, stock assets) which remain subject to their own licenses.
9. Confidentiality
We may receive confidential business information from you. We will use it only to provide the Services and will take reasonable measures to protect it. You agree to do the same for any confidential information we share.
10. Disclaimers
THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee specific outcomes (e.g., SEO rankings, revenue, conversion rates), as results depend on many factors beyond our control.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KMZHERO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE 3 MONTHS PRIOR TO THE EVENT.
12. Termination
We may suspend or terminate access to the Site or Services if you breach these Terms, fail to pay, or if required by law. You may stop using the Site at any time and cancel subscriptions as described above.
13. Governing law
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules.
14. Changes to these Terms
We may update these Terms from time to time. The “Effective date” will be updated. Continued use after changes means you accept the updated Terms.
